Terms & Conditions and Risk Declaration
A. Thank you for choosing Braided River Jet Boating. We aim to provide a friendly, memorable, and safe experience on the river.
B. The name that will appear on your bank or credit card statement is Braided River Jet Boating. All transactions are processed in New Zealand Dollars (NZD).
C. All jet boating and outdoor activities carry inherent risks. By participating in any activity provided by Braided River Jet Boating (“the Operator”), you acknowledge and accept these risks and, to the maximum extent permitted by law, release the Operator and its officers, employees, and agents from any liability, claims, losses, damages, or expenses resulting from any event including, but not limited to:
Personal injury or death
Property loss or damage
Acts that may be considered negligent or accidental
Any other loss, damage, suffering, or emotional distress
1. Participant Agreement
By taking part in the activity, I (the passenger) agree to the conditions above and to the following clauses (1a–1f) and clauses 2–8:
a. I agree that my successors, executors, administrators, and next of kin are bound by these terms and conditions.
b. I agree not to initiate any legal proceedings in any country relating to the risks listed above and will indemnify the Operator against any such claims.
c. I confirm that I am physically fit and do not suffer from any medical condition that could be aggravated by this activity.
d. I consent to receive medical treatment in the event of injury, accident, or illness during the activity and agree to indemnify the Operator for any claims related to such treatment.
e. I understand that any photos, videos, or sound recordings taken during the activity may be used by the Operator at its discretion for promotional or other purposes, without the need for further approval.
f. I agree to follow all instructions given by my driver/guide and to ensure that any children in my care do the same.
2. Responsibility
The Operator and/or its agents accept no responsibility for loss or additional expenses arising from changes, delays, or cancellations of services or activities.
3. Operator Cancellations
The Operator reserves the right to cancel any trip or service due to weather conditions, unsafe river levels, insufficient bookings, or other unforeseen circumstances.
4. Customer Cancellations or Modifications
a. Bookings may be changed or cancelled up to 24 hours before the scheduled departure time by contacting the Operator directly.
b. Cancellations, changes, or no-shows within 24 hours of departure may incur a fee of up to 100% of the ticket price. If you fail to check in on time, you may not be able to participate, and the same fee may apply.
• Where no service is provided due to cancellation or no-show, this fee is considered compensation for loss and is not subject to GST.
c. If a pre-paid booking is not used and no prior notice is given, a fee of up to 100% of the ticket price may be charged as compensation for loss (not subject to GST).
5. Refunds
Refunds will be considered on a case-by-case basis and are entirely at the discretion of the Operator.
6. Policy Exceptions
Any exceptions to the above policies are made solely at the discretion of the Operator.
7. Jurisdiction
These terms and conditions are governed by the laws of New Zealand, and any disputes shall be resolved in the Courts of New Zealand.
